What are risk ratings?
Risk ratings are an internal self-assessment for you to determine your customer’s risk rating that may require additional actions.
They are a standard requirement under AML/CTF regulations in Australia.
For further information, refer to AUSTRAC – Assigning customer risk ratings.
Can my clients view their risk rating?
No, risk ratings are for internal compliance and risk management purposes only and are not visible to your clients.
How do I access the risk assessment tool?
After ordering a check, to access the risk assessment tool:
- select ‘Check history’ on the AML/CTF and VOI order screen
- select ‘Assess’ on the relevant matter.
What is the difference between the risk rating and the risk level provided in Check history?
| Term | Description |
|---|---|
| Risk level | The risk level (under Matter) is determined at a Matter level. For example, if you have 2 individuals (married couple) in a property transaction, the conveyancer would need to conduct a check against both. The risk level applies to both individuals under the matter. |
| Risk rating | The risk rating is for an individual and is based on the PEP and Sanctions check along with the due diligence questions in the risk assessment. |
| Verification status | The verification status relates to the identity document verification of a check. |
How do I receive the report once my client completes the check?
You’ll receive an email with the report attached from no-reply-confirm@globalx.com.au. You can also select ‘Check history’ on the AML/CTF and VOI order screen to see a status of all checks and to access results.
I need to do an in-person check for my client. Can I record it for auditing?
Yes, if you’ve completed an in-person check, you can record it within our service.
On the AML/CTF and VOI order screen, the AML & ID Check option allows you to add information for checks completed in-person.
Why does my report state ‘based on the default profile provided by Realaml’?
Realaml are our AML technology provider, and they have developed the risk profile to determine risk ratings.
The Model Participation Rules by ARNECC apply to my matter. Do I need to retain evidence of verification of identity?
Although the AML/CTF Act 2006 (Cth) doesn’t require you to retain copies of identity documents, the Electronic Conveyancing National Law requires entities to retain evidence of VOI. This means you may need to comply with both sets of obligations.
For further information, refer to Office of the Australian Information Commissioner – Privacy guidance.
Am I covered by the Privacy Act 1988 (Cth) if I’m a small business that is a reporting entity under the AML/CTF Act 2006 (Cth)?
The Office of the Australian Information Commissioner advises the following:
Small businesses that are ‘reporting entities’ under the AML/CTF Act (and their authorised agents) are required to comply with the Privacy Act in relation to the activities for the purposes of, or in connection with their obligations under the AML/CTF Act and the AML/CTF Rules.
